Hai Ha LLC, doing business as CozyGiftAura (“we,” “us,” or “our”), respects the intellectual property rights of others and expects our customers, designers, and partners to do the same. This policy explains how to report suspected copyright infringement on cozygiftaura.com (the “Site”) and how we respond, in accordance with the Digital Millennium Copyright Act (“DMCA”).

1. Our Commitment

The designs sold on CozyGiftAura are original or used under proper license. We do not knowingly sell products that infringe the copyright, trademark, or other intellectual property rights of any person or company. If you believe that material on the Site infringes your rights, please notify us as described below.

2. How to Submit a Copyright Infringement Notice

If you are a copyright owner, or are authorized to act on behalf of one, and believe that content on our Site infringes your copyright, please send a written notice to our designated copyright agent containing all of the following:

  1. Your signature. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. The copyrighted work. A description of the copyrighted work you claim has been infringed. If multiple works are covered by one notice, a representative list.
  3. The infringing material. A description of the material you claim is infringing, and the exact URL(s) of the page(s) on our Site where it appears, with enough detail for us to locate it.
  4. Your contact information. Your full name, mailing address, telephone number, and email address.
  5. Good faith statement. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. Accuracy statement. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner’s behalf.

4. What We Do After Receiving a Valid Notice

When we receive a complete and valid DMCA notice, we will promptly:

  • Review the claim and the material identified;
  • Remove or disable access to the allegedly infringing material, and stop production and sale of any affected product;
  • Notify the person who provided the material (if any) that it has been removed, and forward a copy of your notice; and
  • Cancel and refund any pending orders for the affected product, where applicable.

5. Counter-Notification

If you believe that material was removed or disabled by mistake or misidentification, you may send us a counter-notification containing:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed or disabled, and the location where it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court for the judicial district where your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

Send counter-notifications to the contact in Section 3. If we receive a valid counter-notification, we will forward it to the original complainant. If the complainant does not notify us within 10 business days that they have filed a court action to restrain the alleged infringement, we may restore the material within 10 to 14 business days after receiving the counter-notification.

6. Repeat Infringers

In appropriate circumstances, we will terminate the accounts, or end business relationships, of users or partners who are repeat infringers of intellectual property rights.

7. Misrepresentations

Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Please make sure that you have a legitimate basis before sending a notice or counter-notice. We may share notices, including your contact details, with the party who posted the material.

8. Trademarks and Other Intellectual Property Rights

If you believe that content on the Site infringes your trademark or other intellectual property rights (not copyright), please email [email protected] with: your contact information, a description of your rights (including registration numbers if available), the exact URL(s) of the page(s) at issue, and a statement explaining why you believe the use is unauthorized. We will review your report and take appropriate action.

9. Changes to This Policy

We may update this DMCA Policy from time to time. The updated version will be posted on this page with a new “Last updated” date.
